Grounds for annulment in Texas

Texas laws about annulment is available at http://www.statutes.legis.state.tx.us/Docs/FA/htm/FA.6.htm#6.107 . Mine is listed under Family Code, Subchapter B. Grounds for Annulment, Sec. 6.107. Fraud, Duress, or Force.

As I had mentioned on prior occasions, I believe my marriage was nothing more than an act of benefit fraud for my voidable spouse to gain an immigration benefit through his willful misrepresentation of material fact on his application for permanent residency in the United States.

      Entering into a marriage I thought was based on good will and then divorcing is one thing but remaining in it and continuing it after discovering its fraudulent and malicious origin is to bring great personal liability to myself and my family. For the last several months and since stumbling into this wild circus ride, I have suffered from serious insomnia that reduced my normal 4-hour sleep cycle down to 2 hours per every 24-hour. I am constantly reviewing, questioning and worrying about my role in inadvertently and unknowingly helping this "foreigner" [for I am truly at a loss as to who this person was, has been, is] to access sensitive and personal information, to gain lawful or unlawful employment with the government and the academe ...

      The penalties for the felonious crime of entering into a fraudulent marriage in order to evade U.S. immigration law are a prison sentence of up to five years and a fine of $250,000. And this is not the only charge against the perpetrator; there can be others, including conspiracy and making false statements, with each carrying additional prison terms and financial penalties.

      This mess that I find myself in ... I need to clear my name and that of my family ... and towards that end, I refuse to stay silent.

    2. I'm aware of the Asian tendency to sidestep (one of several consequences of our need for face-saver) and glad that you have chosen to speak your truth and let the chips fall where they may. It can't have been an easy decision nor will it be a painless path but stand your ground and do right by yourself and your family. >:D< and :^{=
